Decision Returned in CollegeNET and Xap Corporation Lawsuit
CollegeNET's principal patent ruled invalid.
Culver City, CA – October 5, 2006 –
A federal court jury in Portland, OR, in the lawsuit between CollegeNET, Inc, and Xap Corporation, ruled that CollegeNet's principal patent is invalid and a second patent was not literally infringed by Xap.
The jury also made the first of a series of decisions about infringement of a single claim under the "doctrine of equivalents."
Decisions regarding the remaining issues will be made at a later time by the judge.
In another claim in the lawsuit, the jury found that Xap violated unfair competition provisions of the Lanham Act.
The judge will decide at a later time what remedy to impose for this violation.
"We are pleased the jury agreed CollegeNET's main patent is invalid and that we do not literally infringe any of its patent claims," said Xap's CEO Liz Dietz.
"We, of course, are disappointed in other parts of the verdict, but this is just the first phase of a many-stage process. We remain confident that in the end we will prevail."
Dietz explained that the challenged Lanham Act practices all occurred in the past.
